Michel Molitor

Renowned for his technical competence, Michel is a member of the senior advisory board to the IBA banking law committee and for over 30 years, he has specialised in banking and finance litigation matters, with solid experience in cross-border cases, banking, investment funds, securities, corporate, insurance and restructuring & insolvency.

• Acting as Luxembourg special counsel of an ad hoc committee of noteholders of a holding company in the restructuring of the company and its group’s debts. Value EUR 250 million.
• Advising a Luxembourg company whose beneficial owner is an ultra high net worth individual who has launched a civil lawsuit to claim damages against a bank and the former directors of the company (who are all employees or ex-employees of the bank). The amount of damages claimed is more than 60 million euros.
• Advised a Luxembourg bank on the legal aspects of an auction sale process to several candidate buyers. MOLITOR assisted the bank and the sellers with all legal aspects of the sale, including the preparation and negotiation of the sellers’ SPA.
• Advising a major German bank which refused to give its approval for the distribution of dividends (9,000,000 EUR) by a borrower to its shareholders. 
• Regularly act for the largest insurer in Luxembourg in all legal matters concerning their insured clients, including major litigation matters.
