Tony Budidjaja

Tony is an internationally-recognized legal practitioner with more than 26 years of experience as an advocate, business law consultant as well as more than 5 years of experience as a mediator and arbitrator in both domestic and international disputes. He has extensive experience and expertise in cross-border Banking, Finance, Capital Market, Securities, Insolvency, Corporate Restructuring, and Commercial Dispute Resolutions. He is one of the few legal practitioners in Indonesia who is qualified as both capital market legal consultant and tax court attorney. Tony is also the first Indonesian lawyer is deemed qualified to speak in person before the Singapore International Commercial Court (SICC).

Tony has successfully handled some of the most high-profile and complex matters with both international and domestic corporate and government clients. Domestically, Tony has been appointed as a Counsltant/Expert at the Conflict Resolution Unit (CRU) inititated by the Indonesian Chamber of Commerce and Industry to support efforts to mediate conflicts over land and natural resource management in Indonesia.

Tony has also been appointed as a member of the Expert Team at the National Legal Development Agency (Badan Pembinaan Hukum Nasional - BPHN) regarding the Draft Contract Law, the National Land Agency (Badan Pertanahan Nasional - BPN) regarding the Draft Minister of Agrarian Affairs/Head of BPN regarding the Land Mediator, and the Supreme Court regarding the Draft Regulation of the Supreme Court of the Republic of Indonesia (PERMA) concerning the Enforcement and Cancellation of Arbitral Awards in Indonesia..

Tony is also an accredited arbitrator and mediator. He is registered in a number of international institutions, such as AIAC, SCMA, and HKIAC, as well as BAKTI (Badan Arbitrase Perdagangan Berjangka Komoditi). Tony has been included in the panel of mediators/arbitrators in a number of institutions both domestically (including the – BAKTI and SJK LAPS) and abroad (such as the International Chamber of Commerce (ICC), China International Economic and Trade Arbitration Commission (CIETAC) and the Hong Kong International Arbitration Centre (HKIAC). He is the founder of the Indonesian Academy of Independent Mediator and Arbitrators (MedArbId) and currently sits as the Chairman.

• Advising one of the largest Chinese state-owned banks in providing a USD 150,000,000 loan facility to a subsidiary of one of the Indonesian giant groups for the development and establishment of a coal-fired power plant and a special terminal in Southeast Sulawesi;
• Advising and assisting various off-shore major international banks and financial institutions in connection with a financing of coal purchase in Indonesia worth more than USD 500,000,000 for a development of 3 x 138 MW Coal-fired Power Plant in Philippines;
• Advising and assisting one of the largest Singaporean banks in preparing securities documents in connection with the refinancing of 38 Indonesian-owned shipping vessels worth approximately SGD 31,000,000;
• Advising one of the largest US-based private equity firms in providing Series – A investment in the amount total around of USD 10,000,000 to several Indonesian E-Commerce based companies; and
• Advising a Thai bank, on the potential dispute with its borrower, one of the largest textile company in Thailand, concerning the allegation that the Client has processed transactions instructed by unauthorized representative of the borrower.
