The Brazilian legal system has its origins in Portuguese law; the country gained independence from Portugal in 1822.
The country has clear restrictions in place for foreign firms and lawyers. Foreign lawyers are forbidden from practicing Brazilian law. Furthermore, domestic lawyers who work for foreign firms are also not allowed to practice Brazilian law.
Foreign lawyers can work as foreign law consultants but can only advise on international law or law from their own jurisdictions.
As a result of such restrictions, some local firms have formed associations with international outfits. In 2010, Brazil’s national bar association’s São Paulo chapter found that alliances between foreign legal consultants and Brazilian lawyers were unethical, but in October of 2012, the federal OAB decided not to make any changes to the present system.
Many prominent law firms in Brazil tend to be based in either São Paulo or Rio de Janeiro, though some have offices in cities throughout Brazil. Some firms such as Demarest Advogados and TozziniFreire Advogados also have New York offices.
