In the area of restructuring and insolvency, the firm provided comprehensive legal support services, both advisory and litigation, to the financial creditor, Asset Care Reconstruction Enterprise Limited, throughout the Corporate Insolvency Resolution Process of the debtor company, ICTL, which resulted in the approval of a resolution/ restructuring plan for ICTL. This case is significant as it is one of the few in which the nature of compulsorily convertible debenture (CCD) was examined in detail to determine whether it constitutes a ‘financial debt’ under the Indian insolvency laws.
